Still waiting for guidance from USCIS on the new H-1B regulation
Although President Bush signed into law a bill granting an extra 20,000 H-1B visas for this fiscal year, USCIS has warned that even though the law goes into effect on March 9, 2005, until there is guidance issued by USCIS on this legislation, all H-1B petitiones filed under the new law will be rejected. At this time, no guidance has been issued. Any new developments in this area will be posted for your information.
Beware of Immigration Scams
We have received calls from many people asking about the new “amnesty” laws
or the new labor certification program as a way to obtain permanent residence In the U.S.
There are no “amnesty” laws in effect at this time. President Bush has spoken often about Immigration reform but there is no agreement in Congress as to how this will take place.
The new labor certification law ( PERM ) is only a means to be able to file a petition for permanent resident status through legal employment. The remainder of the employment-based immigration laws have not changed.
Do not be fooled by anyone who claims to offer permanent residence or a “green card” based on any “amnesty” or based on PERM. Many immigrants have been led to believe these false promises and have paid thousands of dollars to individuals or groups who take their money and do nothing, or worse, do something illegal that results in the non-citizen being placed in deportation proceedings. To be sure of your options under the Immigration laws, and to find out about new legislation, speak with a competent Immigration Attorney who has access to the facts.
"PERM" to take effect March 28, 2005
PERM (Program Electronic Review Management) becomes effective March 28, 2005. This new process for obtaining a labor certification( the first step in obtaining permanent residence through employment) is designed to streamline the process and provide for a much faster decision on the labor certificaton application. However, many questions have been left unanswered. The American Immigration Lawyers Association is working with the Department of Labor to help attorneys and their employers to work out these problem areas.
