As of May 14, 2010, USCIS has received only 19,000 H-1B petitions that will be counted toward the “regular” cap of 65,000. Only 8,100 petitions have been received out of the additional 20,000 petitions exempt from the cap for those with a Masters Degree from a U.S. institution.
These numbers reflect the current state of the economy, and are in stark contrast to previous years when the cap was reached on the same day that the visas became available, April 1st. The H-1B visa is given to employees who work in a “specialty occupation” and who have earned at least a four-year bachelor’s degree.
