Preference categories for employment visas

There are three employment-based immigrant visa classifications. The immigration laws creating these categories are designed to protect the U.S. labor market. This means that the employer and the employee seeking a green card must meet very strict requirements. Most of the categories require the prior approval of the Department of Labor in the form of a PERM labor certification, which is a certification by the Department of Labor that there are no qualified willing U.S. citizen employees in your region to take the position offered. The labor certification process, now called PERM (Program Electronic Review Management), has become increasingly complex since its implementation in 2005.

Once the labor certification is obtained, the employer files a petition with USCIS on behalf of the employee. In this step of the process, the employer must:

  • Show that the job offered qualifies under the particular preference category selected by the employer
  • Show that the employer has the ability to pay the wage offered for the job
  • Show that the employee meets the employer's qualifications for the position
  • Prove that the employee has met all other requirements for legal entry
